[ISLMA-Share] copyright question: students recording themselves reading & giving away recordings as a charity project?

Would they have to get permission from the publisher or from the author?  My guess would be siding more with the publisher than the author.

I am by NO MEANS an expert, but I did take the Copyright workshop at  ICE this year  ("I'm not a copyright lawyer, but I  play one on television," right?) and it sounds like as soon as you start distributing copyrighted material, you lose the fair use claims.



The only way to know for sure, though, would be to consult a copyright lawyer.



Maybe the students could record picture books or poems they've created themselves?



Or part of the lesson could be writing the authors, explaining what they want to do, and asking permission?

I would appreciate any copyright input you all can offer on a particular issue.

A group of 8th graders wants to record themselves reading a picture book (or a few) and then distributing this audio to children in long-term care hospitals. This is for a community project for 8th grade International Baccalaureate Integrated Studies.

Copyright is one of many areas I am looking to grow as a librarian but my red flag went up when their teacher described this idea. Please advise! And thank you all in advance.
