[ISLMA-Share] Follow up question on the Audiobook/Copyright discussion

Thank you for all the feedback on the audiobook/copyright questions.
One final question: 

What if they read a children's book that is in the public domain and
create an audiobook that way? This would entail the teacher filming the
student reading the book and then distributing it for viewing to our
elementary students.

I think if the student were recorded reading a book for an unshared
instructional purpose, ie. an assessment, that would be one thing. But
to record the book in order to make it available to others in lieu of
buying the copy would be an infringement. Most verso pages say you
cannot reproduce in any form and that would include recording. I'm NAL
but very interested in intellectual property issues!

We have found youtube videos of teachers reading our books and have
filed infringement claims to have the files removed from youtube but who
know where else the files have gone or been saved. Just saying...

Although, if it were shared in a controlled manner- say, emailed to the
elementary school or shared via a flash drive, would they be safe? It's
not being widely distributed over the internet.

Hi everyone,

I am pretty sure I know the answer to this but a teacher has asked me
to put
it out on the listserv for suggestions.

She wants to have students create audiobooks. She was thinking of them
taking pictures of the book and then recording their voices over the
images
in a video program. Her idea was to share these readings with
elementary
students. I told her that she couldn't do that because of copyright.
Her
next suggestion was to video the student reading the book on video and
dispersing that way. Still copyright, right?

Any follow up explanation or suggestions to her project to not
infringe
would be greatly appreciated.
