This situation does not really apply to me (or at least it has not needed to yet) although I've read the comments and very much appreciate what was shared. Learning a bit about the Chaffee Amendment may be valuable information for me too, so for that, thank you.

You are correct, we own 1 copy of the workbook for each student. We just need one copy to be digital so that the student can type their answers due to OT accommodations. I think the Chafee Amendment will cover us for changing the format for this student. I have our director of Special Education reading it also so that we both have a good understanding of it.

If it's the workbook the student would be filling out normally with a pencil but is now being uploaded to fill out online, I don't think it's an issue.  You paid for the workbook for the student to use.  You wouldn't be able to upload 1 workbook for a whole class to use, but if this is the format the one student is using, it should be okay.  You wouldn't be able to use that physical workbook for another student.  It also "belongs" to the student in question.

Am I reading the situation correctly?  You aren't trying to avoid paying the creator for their work, you are just modifying the format to meet the student's needs.
Please - someone correct me if I'm incorrect here.  I'm interested to hear other ideas on this one.
