Hi colleagues,

I have been working on getting our teachers to observe copyright laws and
utilize fair use correctly. I am so pleased that someone reached out to
ask me this, but I want to make sure that I am also understanding the law
correctly. If you have a legally compliant answer for the request in red
below, I'd love to hear it. (Even if that means we have to purchase
additional copies.)

For the audiobook, the teachers are planning to play it for their class and
we have purchased 4 copies, which is the number of audiobooks that would be
in use at one time. I know playing a book for an entire class is still a
gray area, but only the teacher would have access to the audiofile. The
students will not. Short of purchasing an audiobook for each student, I
don't see how allowing students access to the digital file would be
compliant.

We have 150 copies of the physical book and about 150 students. If a
student is not actively using the physical copy of the book, can they
access a scanned digital copy? I'm wondering if we would need to purchase
X amounts of ebooks and share them individually with the students who need
them and then restrict access or is this still noncompliant? We are using
Destiny. Is there a way to "recall" an ebook or audiobook from a student
who has it checked out or does the student need to return it?

Thanks for your help!

We have classroom sets of the novel Lightning Thief. Our 6 grade ELA
department will be reading it during the 4th quarter. Teachers were asking
for options if students are absent and fall behind in reading. Can we
digitally scan the novel in chapter segments and share PDFs of small
portions that the student might have missed? We are also purchasing the
audiobook. Can those files be available on Schoology? Just looking for
options to support students if they are not in the classroom or have missed
instruction, while not breaking copyright laws!
